39. FBI direction not to interview witnesses until agents arrived
Nothing on this page claims that the FBI, the Utah State Bureau of Investigation, any officer, or any agent suppressed evidence, acted illegally, or knew anything in advance. The radio line is a short snippet whose full context has not been published. Tyler Robinson is claimed to be the shooter; he is charged, not convicted, has not entered a guilty plea, and is presumed innocent.
The issue in plain words
After a shooting, the first officers on scene normally talk to people who saw what happened. Those first statements are valuable because they are fresh. Nobody has had time to read the news, compare stories, or be shown a photo.
On September 10, 2025, police radio at UVU carried a different instruction. A unit says that, per the FBI, officers have been given "clear direction not to interview" witnesses until federal agents get there. Another unit acknowledges, "we were not going to interview." Some renderings of the audio have the first line as "As per SBI and FBI." In another transmission, the FBI asks local officers to stand by with a private individual at a café until agents reach them. That person has not been charged in this case and is not named here.
This is the context for a simple fact. Very few first-hour witness statements exist in any public record. Investigators call it a freeze. Official-side commentators call it scene control.

The official side says this is how major cases are run. One lead agency controls the interviews so each witness is questioned once, carefully, by trained investigators. If several agencies question the same people separately, the statements drift and a defense lawyer can later use the differences. "Do not interview" can simply mean "the lead agency will handle it." A single radio snippet also does not say which witnesses, for how long, or why.
Utah SBI led the criminal inquiry alongside the Utah County Attorney. The FBI was on the scene the same afternoon. On this view nothing was lost, only organized. Washington County's sheriff later said his office's job on the 11th was to get the suspect in a room and wait — "we're not doing interviews" — because they were not the lead agency. Official-narrative accounts treat that as ordinary de-confliction, the same logic they apply to the courtyard.
They also say resource allocation in a multi-location response looks like a "decoy" only after the fact. Officers sent to a café north of campus may have been following a live lead, not emptying the quad.
What citizen investigators say
Investigators say the timing is the problem. In those same first minutes, dispatch was broadcasting a suspect in "all black," with a "black tactical helmet," a "black mask," and "possibly a tactical vest." The 911 and rooftop-witness page collects that audio. A man who says he filmed the figure on the Losee Center roof before the shot described all-black tactical clothing and a face mask. He says he reported it on campus that day. He has not testified, and his video and report have not been released.
A construction-crew witness described a man in a black trench coat and black mask near campus after the shooting. According to the account circulating, he said the photo officers first showed his crew did not look like the image the FBI released the next day. That mismatch is the black-clothing photo discrepancy. Investigators argue that holding these first accounts until federal agents arrived let the public description move from a masked, all-black figure to the T-shirt figure later tied to Tyler Robinson. Project Constitution posted the radio on September 26, 2025, under the title that local police were ordered not to interview witnesses. The clip itself is filed on this site as Police Radio: "We've Been Given Clear Direction Not to Interview". Ryan Matta posted leaked sheriff audio the same day and said the FBI gave stand-down orders so local officers would not interview eyewitnesses. Investigators present this as a question about how the witness record was gathered, not as proof of any act.
A second thread says officers were tied up for roughly two hours about 43 minutes north of UVU, at a café / biotechnology-building area, standing by with a man later discussed as a distraction figure. The geography is disputed. Witness-footage pressure and the FBI witness-coordination page collect the broader pattern: phones, SD cards, and who was allowed to talk. Former NCTC director Joe Kent has separately said his center's foreign-nexus review was told to stop once Robinson was in custody. Investigators read those stand-downs as the same family of move.

Why it matters for Tyler Robinson
The earliest witness descriptions are the ones least shaped by the official story, and several of them do not describe the man charged. If those accounts were never formally taken, or were taken only after a suspect image had been released, the defense loses the evidence most likely to support Robinson's plea of not guilty. The rooftop-figure chain starts with clothing, not with DNA on a towel. A capital case built after a freeze of the first hour is a different file from one built on those first hours.
What would settle it
- The full radio recordings and CAD log, showing who issued the direction, when, and to whom.
- Any written FBI or SBI instruction on witness handling that day.
- FBI interview reports (Forms 302) for the roof witness, the 911 callers, and the construction crew, with dates and times.
- The photo arrays shown to witnesses on September 10 and 11, and when each was shown.
- The assignment log for the café / off-campus stand-by, including duration and stated purpose.
