Brian Harpole was in the SUV with Charlie Kirk when the shooting occurred. He reported hearing "two distinct sounds" when the shot was fired. He jumped on Kirk alongside Dan Flood to shield him from further harm. In subsequent interviews (Shawn Ryan Show, Salt Lake Tribune), Harpole publicly criticized UVU police for failing to secure rooftops as they had promised. He had texted UVU Police Chief Jeff Long about rooftop security concerns prior to the event. Harpole has also publicly refuted online conspiracy theories regarding the shooting.

Harpole's testimony is critical for establishing security planning failures, the nature and extent of police coordination (or lack thereof) with UVU, the exact timeline and positions of personnel, and his firsthand account of the shooting and immediate response.
