Signed by all four counsel of record: Kathryn N. Nester (Nester Lewis PLLC, Salt Lake City), Richard G. Novak (Pasadena, pro hac vice), Michael N. Burt (San Francisco, pro hac vice), and Staci Visser (Brown, Bradshaw & Moffat, Salt Lake City).
The motion is brought under Utah Rule of Criminal Procedure 16 and the Sixth, Eighth and Fourteenth Amendments, plus Article I sections 7, 9 and 12 of the Utah Constitution. It asks for three things in order: a temporary order stopping further testing of the fragment; an order letting a defense expert examine and photograph it before it is further altered or destroyed; and, failing that, defense observation or video recording of any further testing.
This is the single most important document currently hosted here. It shows the defense moving directly on the inconclusive ATF comparison and on the risk that a fragment is consumed by an examination the defense never sees.

How Documents Are Stored In This Repository
Two locations, and they are not interchangeable:
- The PDF itself goes in
site/internals/static/court/filings/, which Docusaurus copies verbatim into the build. It is then served at/court/filings/FILENAME.pdfand can be linked from any page. - The page describing it goes in
site/docs/court/legal_docs/, which is this directory.
A PDF placed under site/docs/ is not served and will 404 for every real visitor while appearing to work locally.
Honest Statement Of Completeness
Two documents out of a docket approaching a year old is a start, not a collection. The gap is not for want of trying: the Utah County Attorney host was down at the time of the attempt, DocumentCloud blocks scripted access behind Cloudflare, and the authoritative route — Utah XChange — is a subscription service that has to be worked by a person.
The list above is written so that anyone can pick up a row and close it.
